Terms and Conditions

Welcome to Bingo Beatz (also referred to as BQ Beatz). These Terms and Conditions
(“Terms”) govern your access to and use of the Bingo Beatz desktop application, web
application, and related services (collectively, the “Service”), operated through
https://bqbeatz.com/ and our hosted application.
By creating an account, purchasing a token, or using the Service, you agree to these
Terms. If you do not agree, do not use the Service.

1. About the Service
Bingo Beatz is a music bingo platform that allows registered hosts to:
Create local playlists from audio files stored on their own computer
Create and manage bingo games using those playlists
Share games with players, who can join using a game ID or shared link
Play music and run live bingo sessions during a game
The Service is intended primarily for use on desktop computers. We recommend a
computer with 8 GB of RAM or higher for the best experience.

2. Eligibility and Accounts

2.1 Account registration
To host games and manage playlists, you must create an account using a valid email
address and password. You may also provide a display name.
You agree that the information you provide is accurate and that you will keep your
account credentials secure. You are responsible for all activity that occurs under your
account.

2.2 Age requirement
You must be at least 18 years old, or the age of legal majority in your country, to create
an account or purchase a token. If you are under 18, you may only use the Service with
the involvement and consent of a parent or legal guardian.

2.3 Players without accounts
People joining a game as players may participate without creating an account by
entering a display name and game ID. Player session information may be stored locally in
the player’s browser or device.

3. Access Tokens and Subscriptions

3.1 Token required to host
Creating and managing games requires an active access token linked to your account.
Without an active token, hosting features are not available.

3.2 Plans and pricing
Token plans, prices, and durations are displayed in the app at the time of purchase.
Current plans include:

Pro 30 days R400
Plans may include:
Unlimited players and playlists (within the Service’s technical limits)
Local playlist playback
Access for the stated validity period
We may change plans, pricing, or features at any time. Changes apply to new purchases
and do not affect a token that is already active unless stated otherwise.

3.3 Token validity
Your token is valid from the time it is successfully issued until the expiry date and time
shown in your account. After expiry, hosting features are disabled until you purchase a
new token.
Tokens are personal to your account, non-transferable, and do not guarantee
uninterrupted availability of the Service.

3.4 No automatic renewal
Purchases are one-time for the selected period. We do not automatically renew or
charge your payment method when a token expires.

4. Payments

4.1 Payment processor
Payments are processed through Ozow, a third-party payment provider. When you
purchase a token, you may be redirected to Ozow to complete payment in South African
Rand (ZAR).
We do not store your full banking or card details. Payment information is handled by
Ozow in accordance with their terms and privacy practices.

4.2 Successful payment
A token is issued to your account after we receive confirmation of successful payment
from Ozow. If payment fails, is cancelled, or cannot be verified, no token will be issued.

4.3 Refunds
Except where required by applicable law, payments are non-refundable once a token
has been issued. If you believe a payment was made in error, contact us promptly at

5. Local Playlists and Your Content

5.1 Your music files stay on your device
When you create a local playlist, you select a folder on your computer containing audio
files. We do not upload or host your audio files. Playback occurs from files on your
device.

5.2 Metadata we store
To operate the Service, we store playlist and game metadata in our cloud database,
which may include:
Playlist title and description
Song title, artist, file name, file path, and file size
The folder path you selected on your device
Game configuration and song lists used during a session

5.3 Your responsibility for content
You are solely responsible for:
Ensuring you have the legal right to use any music and other content in your
playlists and games
Complying with copyright, licensing, and performance rights that apply in your
venue, event, or jurisdiction
The accuracy and legality of content you create, share, or use through the Service
Bingo Beatz does not provide music licenses and does not verify whether your use of any
track is lawful.

5.4 Prohibited content and conduct
You must not use the Service to:
Infringe intellectual property or other rights of any person
Upload, share, or reference unlawful, harmful, abusive, or offensive material
Disrupt games, attack the Service, or attempt unauthorised access
Misrepresent your identity or impersonate others
Use the Service for any unlawful purpose
We may suspend or terminate access if we reasonably believe you have violated these
Terms.

6. Games and Players

6.1 Hosting games
As a host, you control game settings such as playlist selection, game length (for example
50 or 75 songs), and session progress. You are responsible for how you run your event
and for communicating rules to players.

6.2 Joining games
Players join using a game ID or link you provide. Players may be prevented from joining
after a game has progressed beyond a certain point, as implemented in the Service.

6.3 Player data
When a player joins, we may store their display name, bingo card data, and join time in
connection with the game. Players should only provide a name they are comfortable
sharing with the host and other participants.

7. Intellectual Property

7.1 Our rights
The Service, including its software, design, branding, and documentation, is owned by or
licensed to BQ Beatz and is protected by intellectual property laws. These Terms do not
grant you any ownership rights in the Service.

7.2 Your rights

You retain ownership of content you lawfully control, including your playlists and game
configurations, subject to the licence you grant us below.

7.3 Licence to operate the Service
You grant us a limited, non-exclusive licence to store, process, and display your content
only as necessary to provide and improve the Service, including syncing game state and
playlist metadata to participants.

8. Availability and Changes
We aim to keep the Service available and reliable, but we do not guarantee
uninterrupted or error-free operation. The Service may be unavailable due to
maintenance, updates, internet outages, third-party failures (including Firebase, Ozow, or
payment networks), or events outside our control.
We may modify, suspend, or discontinue any part of the Service at any time.

9. Disclaimer of Warranties
To the fullest extent permitted by law, the Service is provided “as is” and “as available”
without warranties of any kind, whether express or implied, including implied warranties
of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will meet your requirements, that hosting or playback
will be uninterrupted, or that data will always be preserved without loss.

10. Limitation of Liability
To the fullest extent permitted by applicable law:
BQ Beatz and its operators, affiliates, and suppliers will not be liable for any
indirect, incidental, special, consequential, or punitive damages, or for loss of
profits, data, goodwill, or business opportunity, arising from your use of the
Service.

Our total liability for any claim relating to the Service or these Terms will not
exceed the amount you paid to us for the token giving rise to the claim in the 12
months before the event, or R150, whichever is greater.
Nothing in these Terms limits liability that cannot be limited under applicable law,
including liability for fraud or gross negligence where such limitation is prohibited.

11. Termination
You may stop using the Service at any time and may delete your account by contacting
us, subject to our data retention practices described in our Privacy Policy.
We may suspend or terminate your access if you breach these Terms, if required by law,
or if continued provision of the Service is no longer reasonably practicable.
Upon termination, your right to use the Service ends. Provisions that by their nature
should survive termination will continue to apply.

12. Privacy
Our collection and use of personal information is described in our Privacy Policy, which
forms part of these Terms. By using the Service, you acknowledge that you have read our
Privacy Policy.

13. Governing Law
These Terms are governed by the laws of the Republic of South Africa, without regard
to conflict-of-law principles. You agree to submit to the jurisdiction of the courts of South
Africa for disputes arising from these Terms or the Service, unless mandatory consumer
protection laws in your country require otherwise.

14. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the “Last
updated” date above and, where appropriate, notify you through the Service or by other
reasonable means.
Continued use of the Service after updated Terms take effect constitutes acceptance of
the revised Terms. If you do not agree to the updated Terms, you must stop using the
Service.
